It's not that Remus can't adopt Harry, it's that only Sirius OR Remus can adopt him because of the way wizarding adoption laws work -- one adopted father, one adopted mother -- no joint parental adoptions of two men or two women.
I've written the WW as fairly hostile to the idea of homosexual relationships, enough that Remus kept closeted from his best friend and the pair of them maintain the illusion that Remus is a valet out of a need to protect themselves and Harry.
Interesting. But I think Sirius is being a bit reactive about that; Andromeda has made the point that a name and a house is what you make of it. (Something along the lines of, "We're the only ones left who isn't Narcissa. It still means something.")
That is true. And mainly it is that Sirius is afraid of being seen as trying to take over James' place in Harry's life. He refers to him as his son when he's angry or upset, and there's no doubt that he is as good a father as James would have been (possibly better, in some ways, because he understands what a precious opportunity he has) but James Is Harry's Dad. Always will be.
Anyway, seems risky to me to leave Harry in legal limbo like that.
Well, Sirius is his legal guardian, and Remus is a distant relative, so they're mostly safe. If someone did try to take Harry from him, Sirius has enough money and resources to simply take him and Remus and vanish. And Remus is explicitly named as Harry's legal guardian should Sirius die.
But this is probably neither here nor there, since I doubt you're going to do that to them. :)
*grins* well, one never knows, but I do not have any plans for Harry to end up back with the Dursleys anytime soon (and by "soon" I mean "ever" :D)
